Terms of Use

These Terms of Use (hereinafter the "Terms") set forth the conditions governing access to and use of the Atlas Tutti application (hereinafter the "Application").

The Application offers a real-time online multiplayer card game, accessible on mobile and, where applicable, on the web, allowing users to participate in team-based matches, progress through rankings, interact via predefined quick messages, and, where applicable, purchase virtual tokens for use within the Application.

Any use of the Application constitutes full and unreserved acceptance of these Terms.

Atlas Tutti is a trick-taking card game using Spanish cards, based on online multiplayer matches with 4 players in teams of 2 versus 2.

The main features include, but are not limited to:

• creation and management of a user account;
• anonymous or registered authentication;
• participation in real-time online matches;
• a matchmaking system by difficulty-based salon;
• statistics, rankings, grades, levels, and progression;
• a friends system, blocking, and reporting;
• in-app purchases of virtual tokens;
• sending predefined quick messages during gameplay.

The publisher reserves the right to develop, modify, suspend, or discontinue all or part of the Application's features at any time.

Access to the Application requires a compatible device, a sufficient Internet connection, and, where applicable, an account on an application distribution platform.

The Application is provided subject to technical availability. The publisher does not guarantee uninterrupted operation, freedom from errors, or compatibility with all devices, systems, browsers, versions, or networks.

The Application is restricted to persons aged 13 or older.

By creating an account or using the Application, the user declares that they are at least 13 years old. The publisher reserves the right to suspend, restrict, or delete any account created in violation of this requirement.

The user may access the Application through one of the available authentication methods, including:

• an anonymous account linked to the device;
• registration by email and password;
• sign-in via Google;
• sign-in via Apple.

The user agrees to provide accurate, up-to-date, and non-misleading information when creating their account and to keep it up to date.

The user is solely responsible for the confidentiality of their login credentials and for any use of their account. Any activity carried out from the user's account is deemed to have been performed by the user, unless proven otherwise.

The user agrees to use the Application in a fair, reasonable manner consistent with its intended purpose.

The following is strictly prohibited:

• cheating or attempting to circumvent the rules of the game;
• using bots, scripts, automated software, or technical means intended to alter the normal operation of the Application;
• exploiting bugs, vulnerabilities, or manifest errors;
• creating multiple accounts for fraudulent or abusive purposes;
• impersonating another person;
• using an offensive, misleading, hateful, unlawful display name, or one that infringes the rights of third parties;
• engaging in disruptive, abusive, or fraudulent behavior;
• attempting unauthorized access to servers, databases, accounts, or systems related to the service.

The Application may include social features such as:

• adding or removing friends;
• blocking certain users;
• reporting inappropriate behavior or display names;
• displaying rankings and progression data.

Free-form text interactions between users are not available. In-game communications are limited to predefined quick messages.

The user agrees not to misuse social features to harass, discriminate against, threaten, or disrupt other players.

The Application may offer virtual tokens for purchase, usable within the game.

Tokens:

• constitute virtual currency internal to the Application;
• have no real monetary value;
• cannot be exchanged for real money;
• cannot be assigned, transferred, resold, or converted;
• are usable only within the features provided by the Application.

The currently planned economic model is based in particular on the following principle: 1 token corresponds to 1 match, with a victory potentially resulting in the return of the token according to the rules in effect within the Application, while a defeat may result in the loss of the wagered token.

Free bonuses may also be granted, in particular in the form of a daily bonus.

Unless otherwise required by mandatory law or the applicable policy of the relevant distribution platform, token purchases are final and non-refundable.

The publisher reserves the right to correct, adjust, suspend, cancel, or withdraw all or part of a token balance in the event of:

• a manifest technical error;
• fraud or attempted fraud;
• abusive activity;
• cancellation or invalidation of a transaction;
• non-compliance with these Terms.

In-app purchases are processed by the relevant distribution platforms, including the Apple App Store and Google Play.

The publisher does not directly collect the user's complete banking information and does not itself handle the primary payment processing.

The user is solely responsible for purchases made from their account or device, subject to the applicable rules of the relevant platform.

In the event of non-compliance with these Terms, suspicious, fraudulent, or abusive activity, or behavior detrimental to the proper functioning of the service, the publisher reserves the right, at any time and without compensation, to:

• limit access to certain features;
• temporarily suspend an account;
• ban a user;
• delete an account or certain associated elements;
• cancel advantages, rewards, tokens, or progression obtained irregularly.

Such measures may be taken without prior notice where the severity of the situation so warrants.

The publisher endeavors to ensure the accessibility of the Application, without any obligation of result.

Access to the Application may be interrupted, suspended, or limited, in particular for reasons of:

• maintenance;
• updates;
• security;
• technical constraints;
• network overload;
• failure of a service provider or technical infrastructure.

The publisher shall not be held liable for temporary interruptions, slowdowns, connection losses, incompatibilities, or unavailability resulting from such situations.

The publisher takes reasonable measures to preserve data related to the user's account and progression.

However, the user acknowledges that technical incidents, software errors, network failures, maintenance operations, synchronization anomalies, or security measures may, in certain cases, result in:

• partial loss of progression;
• desynchronization of certain data;
• temporary unavailability of features;
• adjustment of scores, statistics, or tokens.

Except in cases of gross negligence or mandatory legal provisions to the contrary, the publisher shall not be held liable for such indirect or incidental damages.

All elements comprising the Application, including but not limited to:

• the name Atlas Tutti;
• graphics;
• the interface;
• texts;
• databases;
• visual, audio, and software elements;
• trademarks, logos, and content,

are protected by applicable intellectual property rights and remain reserved to their rightful owner.

No intellectual property rights are granted to the user under these Terms.

Any unauthorized reproduction, extraction, copying, adaptation, distribution, commercialization, or exploitation, whether in whole or in part, is prohibited.

The user may request the deletion of their account from within the Application or through the means made available on the official website.

Deletion results in the deactivation of the account and the commencement of a grace period of thirty (30) days, during which the request may be canceled in accordance with the procedures provided by the Application.

At the end of this period, account data is deleted or anonymized, except where retention is necessary:

• for compliance with a legal obligation;
• for fraud prevention;
• for the establishment, exercise, or defense of legal claims;
• or for the security of the service.

Account deletion may result in the permanent loss of access to tokens, statistics, rankings, match history, and other elements linked to the account, subject to applicable legal obligations.

The Application is provided "as is," subject to applicable statutory warranties.

The publisher does not guarantee:

• the complete absence of errors or bugs;
• the absence of interruptions;
• the achievement of any particular result or ranking;
• permanent compatibility with all devices or software versions;
• the absence of misconduct by other users.

To the extent permitted by law, the publisher shall only be liable for direct, certain, and foreseeable damages resulting from a fault attributable to the publisher.

In any event, the publisher shall not be liable for indirect damages, including but not limited to loss of opportunity, loss of business, loss of non-essential data, reputational harm, or commercial loss.

The publisher may amend these Terms at any time.

The applicable version is the one published within the Application or on the official website at the time of consultation. In the event of a substantial modification, the user may be notified through any appropriate means.

Continued use of the Application following an update constitutes acceptance of the amended Terms.

These Terms are governed by French law, subject to any mandatory provisions that may apply in the user's country of residence.

In the event of a dispute, the parties shall endeavor to reach an amicable resolution before initiating any legal proceedings.

Failing an amicable agreement, the dispute shall be submitted to the competent courts in accordance with applicable rules of general jurisdiction.
